Lima, Oct 20 (EFE) .- Representatives of indigenous and civil organizations in Peru on Wednesday asked the Constitutional Court (TC) to declare the “strict intangibility” of the territory of an Amazonian reserve in the south of the country for protect people in a situation of isolation and first contact (Piaci).
The claim was based in a public hearing held by the TC on an amparo process presented in August 2013 by the Institute for the Legal Defense of the Environment and Sustainable Development (Idlads), as reported by the plaintiffs at Efe.
The Interethnic Association for the Development of the Peruvian Jungle (Aidesep), which joined the process in September 2019, and the Law, Environment and Natural Resources Association (DAR), also participated, which supported an “amicus curiae ”(legal opinion) on the subject.
The lawsuit asks the Ministry of Energy and Mines (Minem) to exclude the territorial reserve of Kugapakori, Nahua, Nanti, which includes 456,672 hectares in the territories of the regions of Cusco and Ucayali, “from any promotion, exploration or exploitation of hydrocarbons, with attention to the extreme vulnerability of the Piaci who live there ”.
ORDER AGAINST PLUSPETROL
In this regard, it was requested that Pluspetrol, the majority partner of the consortium which operates the Camisea gas field, in Cusco, be ordered to refrain from carrying out exploration and exploitation operations in the area of block 88 ” because that represents a danger for the survival of the Piaci ”.
In addition, it was reported that a prior consultation process with the Cashiriari and Segakiato communities, which adjoin the reserve and are located in the area of influence of this block, has been omitted.
